Schedule X – Unpaid pandemic leave and annual leave at half pay extended
The Fair Work Commission in April 2020 varied 99 Modern Awards by inserting a new Schedule – ‘Schedule X: Additional measures during the COVID-19 pandemic’. Schedule X provides an entitlement to unpaid pandemic leave and the ability to take twice the amount of annual leave at half pay (additional measures during the COVID-19 crisis). These provisions were due to expire on 30 June 2020.
The Commission has extended the operation of Schedule X from 1 July 2020 however the cessation date of Schedule X now varies between the awards:
- 31 July 2020 (Fast Food, General Retail, Storage Services & Hair and Beauty Awards);
- 30 September 2020 (Majority of the 99 Awards);
- 31 December 2020 (Air Pilots Award);
- 30 June 2021 (Live Performances Award); and
- Until further order is issued (Health Sector Awards).
Employers now more than ever, should review awards relevant to their business and keep track of award changes and the expiry dates of temporary flexibilities currently available under many awards.
